Terms of use

Last updated

Draft, not yet reviewed by a lawyer. This text is a starting point and may change before On The Go is released.

These terms cover the On The Go app ("the app") and the free On The Go Helper ("the helper"), made by PLACEHOLDER legal name ("we"). By installing or using them, you agree to these terms.

1. Licence

When you get the app from the Mac App Store, Apple's Licensed Application End User License Agreement applies, and these terms add to it. If the two disagree, Apple's agreement wins. You may use the helper, for free, on any Mac you own or control, together with the app. You may not copy, sell, or modify the app or the helper, or try to get around how the helper checks which app may use it.

2. What the app does

The app keeps your Mac awake while On the Go mode is on. With the helper installed, it can also keep the Mac awake with the lid closed. It turns the mode off when the battery reaches the level you pick, when the Mac gets too hot, or when the time you set runs out. These cut-offs depend on information from macOS and may not always work, for example if macOS reports the battery or heat late, or the app is stopped.

3. Heat, battery and your Mac

A Mac that stays awake keeps using power and making heat, more so with the lid closed or in a bag. The safety cut-offs are there to help, but you are responsible for where your Mac is and how it's ventilated while the mode is on, for its battery, and for any work, data or connection that depends on it staying awake. Don't leave a running Mac in a closed bag, a hot car or anywhere it can't cool down, and don't rely on the app where a failure could harm someone or cause loss.

4. No warranty

The app and the helper are provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that they'll be error-free, work without interruption, keep a network connection alive, or prevent overheating, battery drain or data loss.

5. Limitation of liability

To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost work, lost profits, or damage to your Mac or its battery, arising from using or being unable to use the app or the helper, even if we were told such damage was possible. Our total liability for any claim is limited to the amount you paid for the app.

6. Your rights as a consumer

Some countries don't allow these exclusions or limits. Where they don't, they apply only as far as the law allows, and nothing here takes away rights you have as a consumer that can't be waived. Refunds for App Store purchases are handled by Apple.

7. Changes and ending

We may update these terms; the date at the top shows the latest version. You can stop using the app at any time by uninstalling it (see Support).

8. Governing law

These terms are governed by the laws of PLACEHOLDER country, except where your local consumer law says otherwise.
